RIGHT TO SALARY COMPENSATION

Insured persons of contracting states

Citizens of contracting states who have acquired the status of insured persons in the Croatian Health Insurance Fund, for example due to their employment with an employer based in Croatia, are entitled to a compensation of salary during their temporary incapacity or inability for work, in accordance with Croatian legislation.

Persons with compulsory health insurance in other contracting states exercise their right to salary compensation during temporary incapacity/inability to work incurred during their stay in Croatia (for example, during temporary work in Croatia) in accordance with the legislation of their home country.

Citizens from non-contracting states

Citizens from non-contracting states that have regulated the status of compulsory health insurance in the Croatian Health Insurance Fund are entitled to rights from compulsory health insurance in Croatia as well as other insured persons in the Croatian Health Insurance Fund.

QUESTIONS AND ANSWERS:

Temporary incapacity for work, which occurred during temporary work in another contracting state, can be determined by the contracted physician in the state in which you temporarily work. The same physician will also issue you a certificate of temporary incapacity for work.

In case of temporary incapacity for work incurred in another contracting state, you are obliged to notify your employer and the competent health insurance holder in your home country, within the deadlines provided by the legislation of your home country. You can do this either personally or through the health insurance holder in the state of temporary work.

Compensation for your salary will be paid by the health insurance holder of your home country.

A Croatian insuree, engaged in temporary work in a contracting or non-contracting state, is entitled to a salary compensation in accordance with the Croatian legislation on compulsory health insurance, and such compensation shall be paid at the expense of the Croatian Health Insurance Fund or the state budget only during his or her stay in Croatia. There is an exception in case of maternity leave and leave in case of death of a child (in case of stillborn child or death of a child during maternity leave) when the salary compensation is paid even during stay outside Croatia.
